What if I am unhappy with an EHCP related decision?

Sometimes a decision may not be what you were hoping or expecting. We aim to resolve any issues with you directly.

If you are still unhappy after discussing your concern with us, you do have options.

1. Contact the SEND Support, Assessment and Review Team

Please get in touch with the SEND Support, Assessment and Review Team if unhappy or concerned. We aim to work with you to address these concerns. An explanation for decisions made will always be shared with you.

If you have new advice or evidence, please send us a copy. It may make a difference to our original decision. You should contact:

2. Receive independent mediation

If we are unable to reach an agreement, you can receive independent mediation. This person will give impartial advice for your concern. They help both sides work out an agreement. Everything you discuss is confidential. Mediation is usually quicker than going to tribunal.

3. Apply to a SEND tribunal

We hope that your concerns are addressed after mediation. If they are not, you may decide to apply to a SEND tribunal.

You can only apply to SEND tribunal after contacting the mediation service. They will discuss with you whether mediation is suitable for resolving the disagreement. If it is, they will give you a mediation certificate.

You should apply for SEND tribunal within two months of receiving the letter detailing the decision.
