What if I am unhappy with an EHCP related decision?

Sometimes a decision may not be what you were hoping for. You may have hoped for a different decision about:

  • a personal budget
  • the school that has been chosen or recommended in an Education Health and Care Plan (EHCP)
  • the support detailed in an EHCP

Please know that Newcastle City Council always aims to:

  • give support that suits each child or young person’s needs
  • use the resources we have wisely and efficiently
  • choose the best available option when the ideal one isn’t possible

If you are still unhappy after discussing your concern with us, you do have options.

1. Contact the SEND Support, Assessment and Review Team

When unhappy with a decision, you can get in touch with the SEND Support, Assessment and Review Team. They can work with you to address your concerns and discuss options. 

If you have new advice or evidence, please send us a copy. It may make a difference to our original decision. You should contact:

2. Receive independent mediation

If we are unable to reach an agreement, you can receive independent mediation. This person will give impartial advice for your concern. They help both sides work out an agreement. Everything you discuss is confidential. Mediation is usually quicker than going to tribunal.

3. Apply to a SEND tribunal

We hope that your concerns are addressed after mediation. If they are not, you may decide to apply to a SEND tribunal.

You can only apply to SEND tribunal after contacting the mediation service. They will discuss with you whether mediation is suitable for resolving the disagreement. If it is, they will give you a mediation certificate.

You should apply for SEND tribunal within two months of receiving the letter detailing the decision.
